- Primero. REVOCAR los fallos proferidos por el Tribunal Superior del Distrito Judicial de Cali, Sala Laboral, el 2 de junio de 2000 y por el Consejo de Estado, Sala de lo Contencioso Administrativo, Sección Primera, el 1 de junio de 2000, al resolver sobre las acciones de tutela incoadas por Abraham Cortés Ludgardo y Fabián Gonzalo Cano López contra el Municipio de Cali y el Hospital San Fernando de Amagá, respectivamente, y en su lugar, conceder las tutelas solicitadas.
- Segundo. ORDENAR al Municipio de Cali y al Hospital San Fernando de Amagá, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, se pongan al día en el pago de los aportes que adeudan a las respectivas cajas de compensación por concepto del subsidio familiar correspondiente a los solicitantes, con el fin de proteger el mínimo vital de los menores afiliados.
- Tercero. Por Secretaría LÍBRESE la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
