- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- PRIMERO. REVOCAR el fallo proferido por el H. Consejo de Estado, el día 6 de octubre de 1993, y en su lugar conceder la tutela solicitada por el señor ENRIQUE MALDONADO SANTOS, por la vulneración del derecho de petición consagrado en el artículo 23 de la Constitución Política, por las razones expuestas en esta sentencia.
- SEGUNDO. ORDENAR a COOPDESARROLLO, a través de su Gerente, para que dentro del término de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo, dé respuesta por escrito al peticionario de la tutela acerca de si recibieron dineros públicos del presupuesto nacional de inversión del Departamento Administrativo Nacional de Cooperativas, DANCOOP, e informen acerca de los resultados sociales de su inversión.
- TERCERO. ORDENAR que por Secretaría se comunique esta providencia al Tribunal Administrativo de Cundinamarca, en la forma y para los efectos previstos en el artículo 36 del Decreto 2591 de 1991.
