- Primero. CONFIRMAR parcialmente, por las consideraciones expuestas en la parte motiva de esta providencia, las sentencias proferidas por las Salas Laboral y Penal de la H. Corte Suprema de Justicia el 29 de enero y el 4 de marzo del año 2003 respectivamente, dentro de la acción de tutela instaurada por el señor Pedro Joaquín Betancourt Sánchez contra la Sala Laboral del H. Tribunal Superior de Tunja.
- En consecuencia revocar las decisiones que se revisan en cuanto consideran improcedente la protección, y en subsidio negar el amparo porque las garantías constitucionales del actor no fueron conculcadas.
- Segundo. Por Secretaría líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991.
