- en nombre del pueblo y por mandato de la Constitucion,
- R E S U E L V E :
- Revocar parcialmente el fallo proferido por la Honorable Corte Suprema de Justicia, Sala Penal, el dia 19 de octubre de 1994 en cuanto nego al accionante ALEXANDER TENORIO para efectos de su reintegro, el amparo de los derechos demandados, y en su lugar se dispone lo siguiente:
- PRIMERO. Tutelar los derechos fundamentales al trabajo y al acceso a la administracion de justicia, a fin de que se de cumplimiento al fallo proferido por el Juzgado
- Cuarto. Laboral del Circuito de Cali de fecha 29 de junio de 1993, en el sentido de reintegrar al senor ALEXANDER TENORIO al cargo de operario de empaquetadora o a otro de igual o superior categoria y remuneracion, siempre y cuando que a la fecha de la notificacion de esta sentencia no se haya efectuado dicho reintegro.
- A la anterior providencia se le debera dar cumplimiento por parte de la demandada, dentro del termino de cuarenta y ocho (48) horas contado a partir de la notificacion a la misma.
- SEGUNDO. No acceder a las demas pretensiones formuladas por el peticionario de conformidad en lo expuesto en la parte motiva de esta providencia.
- TERCERO. Comunicar esta decision al Tribunal Superior del Distrito Judicial de Cali, Sala Penal, para que se notifique esta providencia y se proceda de conformidad con lo establecido en el articulo 36 del Decreto 2591 de 1991, con las prevenciones legales correspondientes, de que trata el articulo 52 del mismo decreto.
