- Primero. REVOCAR la sentencia proferida por el Juzgado
- Octavo. Laboral del Circuito de Medellín el 8 de julio de 1999, mediante la cual se negó por improcedente la acción de tutela incoada por Gustavo Aníbal Cardona Sánchez.
- Segundo. En su lugar, CONCEDER la protección a una vida digna, al mínimo vital, a la seguridad social, al pago oportuno y al reajuste periódico de las mesadas pensionales.
- Tercero. ORDENAR a la Sociedad "Hijos de Eleazar Ospina y Cía. Ltda, de Medellín & Cía. Comandita por acciones" que, en el término de cuarenta y ocho (48) horas contadas a partir de la notificación del presente fallo, proceda a cancelarle al actor la totalidad de las mesadas pensionales adeudadas y, en adelante, dar cumplimiento exacto y oportuno a sus obligaciones con el pensionado, lo cual será verificado por el juez de primera instancia.
- El desacato a lo aquí ordenado dará lugar a la imposición de las sanciones previstas en el artículo del Decreto 2591 de 1991.
- Cuarto. CORRASE traslado al Fiscal General de la Nación para lo de su competencia.
- Quinto. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
