Primero. REVOCAR las sentencias proferidas por el Juzgado
Primero. Civil del Circuito de Girardot, y por la Sala Civil del Tribunal Superior de Cundinamarca el 12 de febrero y el 15 de marzo de 2002 respectivamente, dentro de la accion de tutela instaurada por Celmira Ramirez Gomez contra el Juez
Tercero. Penal del Circuito de Girardot y el Inspector de Policia de Ricaurte.
Segundo. CONCEDER a la actora la proteccion de su derecho fundamental al debido proceso. En consecuencia ordenar al Juez accionado que restablezca a la senora Ramirez Gomez en la posesion del inmueble ubicado en la Diagonal 7 N. 14 B-20 de la nomenclatura urbana del municipio de Ricaurte (Cund.).
Y se previene al Juez
Tercero. Penal del Circuito de Girardot, para que de ser procedente hacer cesar los efectos del punible de invasion de tierras, cometido en el mismo municipio por el senor Luis Alberto Parra calderon, ordene la diligencia correspondiente, previo alindamiento e identificacion del bien objeto de la medida, con sujecion a las normas procesales, y con pleno respeto de los derechos de los terceros ocupantes del inmueble. Prevencion que debera hacerse conocer de funcionario comisionado, si es del caso.
Tercero. Ordenar a la Secretaria General de esta Corporacion el envio de las comunicaciones previstas en el articulo 36 del Decreto 2591 de 1991.
