Solicitudes de nulidad de la sentencia T-723/16, formuladas por las Secretarías Jurídica y de Seguridad, Convivencia y Justicia de Bogotá.
Las peticiones se fundamentaron en una incongruencia entre la parte motiva y la resolutiva que genera incertidumbre respecto del alcance de la decisión proferida y, el hecho de que en la parte resolutiva se impartieron órdenes a particulares que no fueron vinculados al proceso y que no tuvieron la oportunidad procesal para intervenir en su defensa.
La Corte considera que el segundo cargo prospera, en tanto se dieron órdenes a la Alcaldía Distrital sin ser vinculada a la tutela y sin tener la oportunidad procesal para intervenir en su defensa.
Se declara la NULIDAD de la referida providencia y como medida cautelar, mientras se profiere el fallo de reemplazo, se ordena a la Secretaría Distrital de Seguridad, Convivencia y Justicia de Bogotá mantener la vinculación a la accionante, bajo las mismas condiciones que se le concedieron al dar cumplimiento a la sentencia T-723/16.

- PRIMERO. DECLARAR LA NULIDAD de la Sentencia T-723 de 2016, solicitada por Secretaría Jurídica Distrital de Bogotá.
- SEGUNDO. Como medida cautelar mientras se profiere la sentencia de reemplazo, ORDENAR a la Secretaría Distrital de Seguridad, Convivencia y Justicia de Bogotá, mantener la vinculación de la señora María Eugenia Leyton Cortés bajo las mismas condiciones que se le concedieron al dar cumplimiento a la citada providencia T-723 de 2016
- TERCERO. Por Secretaría General de la Corte Constitucional, REMITIR el expediente al despacho de la magistrada sustanciadora del presente asunto, para que proyecte la nueva sentencia, que deberá ser adoptada por la Sala Plena de la Corte Constitucional.
