Con el presente auto la Sala Plena de la Corporación decide declarar de oficio la NULIDAD del registro de fallo en el proceso de constitucionalidad de la referencia, realizado el 15 de abril del 2021, por cuanto para la fecha se encontraba suspendido su trámite por el estudio de una recusación presentada dentro del mismo expediente.
Consideró la Sala que lo anterior constituye una irregularidad que afecta el debido proceso y que está prevista expresamente en la ley como una causal de nulidad.
Así mismo, ordena rehacer la actuación procesal declarada nula anteriormente.
