El rechazo se dio porque el contenido normativo acusado no existe en el ordenamiento como consecuencia de una decisión que hizo tránsito a cosa juzgada y, porque la Corte es manifiestamente incompetente para valorar, en sede de control abstracto, el cumplimiento o incumplimiento de sus sentencias por parte de las autoridades administrativas y judiciales.
Por considerar que el rechazo procede, al configurarse la falta de competencia en virtud del fenómeno de sustracción de materia, la Sala Plena. decide confirmar el auto recurrido.
