Solicitud de aclaración de la Sentencia T-166/21, invocada por el Gerente de Defensa Judicial de Colpensiones.
La Corte considera que no hay lugar a acceder a la anterior petición, toda vez que el memorialista no acreditó legitimidad en la causa por pasiva para pedir la aclaración del precitado fallo.
No obstante lo anterior, en ejercicio de las competencias que le otorga el artículo 285 del Código General del Proceso, la Sala ACLARA oficiosamente su numeral 2º , en el sentido de precisar que la autorización a Colpensiones para deducir los valores pagados a favor del demandante, se refiere a la indemnización sustitutiva de la pensión de vejez, regulada en el artículo 37 de la Ley 100 del año 1993.

- Primero. ACLARAR oficiosamente el numeral 2o de la sentencia T-166 de 2021, en el sentido de precisar que la autorizacion a Colpensiones para deducir los valores pagados a favor del demandante, se refiere a la indemnizacion sustitutiva de la pension de vejez, regulada en el articulo 37 de la Ley 100 del ano 1993.
