Solicitud de nulidad del auto mediante el cual se negó la petición de convocar a audiencia pública dentro del expediente de la referencia.
El memorialista considera que concurre dos causales que demuestran la violación al debido proceso.
Una, la falsa motivación y la otra, la falta de estudio de los motivos del asunto a resolver, cuyo análisis conllevaba a una sustentación diferente de la parte resolutiva del mismo, capaz de provocar una decisión diferente.
Luego de analizar los argumentos del memorialista recordó la Corte que las solicitudes de nulidad en contra de autos de trámite, según lo ha determinado la jurisprudencia constitucional de manera pacífica y reiterada, son abiertamente improcedentes y, en consecuencia, se deben RECHAZAR de plano, como sucedió en este caso particular.
