Con este auto se resuelve la manifestación de impedimento formulada por la magistrada Diana Fajardo Rivera, para participar en la decisión del asunto.

Según la magistrada, se encuentra incursa en dos causales establecidas en el artículo 56 de la Ley 906 de 2004.

Estas son: (i) la existencia de un interés en la actuación procesal, prevista en el numeral primero; y (ii) la presencia de una “amistad íntima o enemistad grave entre alguna de las partes, denunciante, víctima o perjudicado y el funcionario judicial”, prevista en el numeral quinto.

Luego de analizar los argumentos presentados por la doctora Fajardo la Sala encontró acreditada una de las causales invocadas, esto es, la amistad intima de su familia con el abogado defensor del proceso penal del tutelante.

Con base en lo anterior y, con el propósito de preservar las garantías de transparencia, imparcialidad e independencia de la justicia se ACEPTÓ el impedimento y se separó a la magistrada Diana Fajardo Rivera del conocimiento del proceso correspondiente a la tutela T-8817100.

  3. Segundo. SEPARAR a la magistrada Diana Fajardo Rivera del conocimiento del proceso correspondiente a la acción de tutela T-8.817.100.
