Recurso de súplica.
La demanda se rechazó porque el actor no presentó escrito de subsanación.
La Sala Plena de la Corporación consideró que el recurso interpuesto no cumplió con la carga argumentativa necesaria para que proceda.
En este aspecto se refirió que el demandante no controvirtió el hecho de la presentación extemporánea del escrito de subsanación, sino que dedicó su escrito a insistir en las razones planteadas en la demanda.
Por lo anterior, se RECHAZÓ el recurso impetrado.
Respecto al escrito de coadyuvancia que presentó otro ciudadano para respaldar la súplica del demandante, la Corte decidió rechazarlo también, por improcedente.

- PRIMERO. RECHAZAR el recurso de súplica presentado por Domingo Banda Torregroza, dentro del expediente D-15.052, en contra del Auto del 27 de enero de 2023 proferido por el magistrado Alejandro Linares Cantillo.
- SEGUNDO. RECHAZAR, por improcedente, el escrito de coadyuvancia al recurso de súplica presentado por Germán Fernández Cabrera, dentro del expediente D-15.052.
- TERCERO. Por intermedio de la Secretaría General, COMUNICAR el contenido de esta decisión al demandante, advirtiéndole que contra esta no procede recurso alguno. Asimismo, comunicar la decisión al señor Germán Fernández Cabrera.
- CUARTO. Una vez quede ejecutoriado el presente auto, ARCHIVAR el expediente.
