Se declaró la nulidad de todo lo actuado en la tutela a partir del auto proferido por la Sala Civil-Familia del Tribunal Superior del Distrito Judicial de Cartagena, toda vez que la actuación surtida no es ajustada a derecho, pues se adelantó con fundamento en la competencia establecida por el Decreto 1382 de 2000, cuyo contenido material es contrario al ordenamiento superior, toda vez que modificó la competencia para conocer de las acciones de tutela.
En consecuencia, se ordenó remitir el expediente a la citada Sala para que continúe con el trámite de esta acción de tutela, por haber sido la autoridad judicial inicialmente escogida por el accionante, de conformidad con el Decreto 2591 de 1991.

- Primero. DECLARAR la nulidad de todo lo actuado en la presente acción de tutela, a partir del Auto de fecha 28 de febrero de 2001 proferido por la Sala Civil-Familia del Tribunal Superior del Distrito Judicial de Cartagena.
- Segundo. ORDENAR que por la Secretaría General de esta Corporación se remita el expediente a la Sala Civil-Familia del Tribunal Superior del Distrito Judicial de Cartagena, para que de manera inmediata continúe con el trámite de esta acción de tutela, por haber sido ella la autoridad judicial inicialmente escogida por el accionante, de conformidad con el Decreto 2591 de 1991.
