Conflicto de Competencia.
El proceso le correspondió por reparto al Juzgado Primero Promiscuo Municipal de Baranoa (Atlántico), despacho que se declaró sin competencia al considerar que la demanda debía remitirse a los jueces de Sabanagrande, porque la entidad accionada trasladó sus oficinas a dicho municipio y por tanto, allí era donde se producía la supuesta vulneración de derechos.
Efectuado nuevo reparto el Juzgado Promiscuo Municipal de Sabanagrande declaró también su falta de competencia, bajo el argumento de que Baranoa era la sede de la entidad demandada.
La Corte Constitucional luego de reiterar las normas que determinan la competencia en materia de tutela y de precisar el significado del concepto “competencia a prevención”, decide el conflicto ordenando enviar el expediente de tutela al Juzgado Primero Promiscuo Municipal de Baranoa (Atlántico), para que sin más demoras tramite y profiera decisión de fondo respecto del amparo solicitado.
