Conflicto de competencia suscitado entre el Juzgado Promiscuo Municipal de Sibundoy (Putumayo) y el Juzgado Tercero Penal Municipal con Funciones de Control de Garantías para Adolescentes de Pasto.
Concluye la Corte que el despacho judicial de Sibundoy es quien debe asumir el conocimiento de primera instancia de la acción de tutela formulada, en tanto, además de ser el lugar escogido por la peticionaria, es donde se producen los efectos de la presunta vulneración de su derecho de petición.
En consecuencia, se ordena remitir el expediente a dicha autoridad, para que sin dilación alguna profiera la decisión de fondo que corresponda.

- PRIMERO. DEJAR SIN EFECTOS el Auto del el 6 de abril de 2017, proferido por el Juzgado Promiscuo Municipal de Sibundoy -Putumayo-, en el trámite de la acción de tutela interpuesta por la señora María Ofelia Benavides Jacanamijoy contra Comcel S.A.
- SEGUNDO. REMITIR el expediente ICC-2853 al Juzgado Promiscuo Municipal de Sibundoy -Putumayo- para que sin dilación profiera decisión de Fondo.
- TERCERO. ORDENAR que, por Secretaría General de esta Corporación, se comunique la decisión adoptada en esta providencia a las partes y al Juzgado
