La causal invocada por la Jefa del Ministerio Público fue haber intervenido, en su anterior condición de Ministra de Justicia y del Derecho, en la expedición de la norma objeto de control constitucional.
La Corte decidió ACEPTAR el impedimento manifestado por la Procuradora General para emitir concepto dentro del expediente de la referencia y, en consecuencia, ordenó correr traslado por el término que falte al Viceprocurador General de la Nación, para que rinda el concepto de que tratan los artículos 242 numeral 2 y 278 numeral 5 de la Carta Superior.
