Se declaró la nulidad de todo lo actuado en la tutela promovida por la ciudadana de la referencia contra la Gobernación de Bolívar, a partir del auto proferido por el Tribunal Administrativo de Bolívar, lo anterior, porque el mencionado Tribunal aplicó lo dispuesto en el Art. 1 del Decreto 1382 de 2000.
En ocasiones semejantes, esta Corte ha decidido que no le corresponde pronunciarse de fondo sobre la tutela, sino anular todo lo actuado después de que el juez que es competente inaplicó la Constitución y prefirió aplicar el decreto reglamentario citado.
En consecuencia, se remitió el expediente al mencionado Tribunal para que realice el trámite que corresponda conforme a la Ley.

- Primero. DECLARAR la nulidad de todo lo actuado en la accion de tutela promovida por la senora Josefa Barraza de Castillo, contra la Gobernacion de Bolivar, a partir del auto del 7 de septiembre de 2000 proferido por el Tribunal Administrativo de Bolivar.
- Segundo. REMITASE el expediente al Tribunal Administrativo de Bolivar, para que, de forma inmediata se le imprima a esta accion de tutela el tramite que corresponda conforme a la Ley.
