En consecuencia, la Corte declaró la nulidad de todo lo actuado en la tutela promovida por el ciudadano de la referencia contra DATACRÉDITO DE COMPUTEC S.A., a partir del auto por medio del cual el juzgado 5º Civil del Circuito de Bogotá se declaró incompetente para conocer del asunto, lo anterior, por violación al debido proceso y acceso a la administración de justicia.

- Primero. Inaplicar, por ser manifiestamente contrario a la Constitucion Politica, el articulo 1o del Decreto 1382 de 2000.
- Segundo. Por violacion al debido proceso y acceso a la administracion de justicia, declarar la nulidad de todo lo actuado en la accion de tutela promovida por el senor Arturo Aris Avila contra DATACREDITO DE COMPUTEC S.A., a partir del auto del seis (6) de junio de 2002, incluido este, por medio del cual el juzgado 5o Civil del Circuito de Bogota se declaro incompetente para conocer del asunto.
- Tercero. Ordenar al Juzgado 5o Civil del Circuito de Bogota que asuma de manera diligente el conocimiento de la tutela de la referencia.
