Se anuló el auto mediante el cual el Juez 40 Civil del Circuito de Bogotá se declaró incompetente para conocer de la tutela presentada por el ciudadano de la referencia contra Computec S.A., lo anterior porque el citado juzgado aplicó el Art. 1° del Decreto 1382 de 2000 desconociendo la Constitución.
En consecuencia, se envió el expediente para que realice el trámite que corresponda.

- Primero. Anular el auto de abril 23 de 2002, mediante el cual el Juez Cuarenta Civil del Circuito de Bogota, al aplicar el articulo 1deg del Decreto 1382 de 2000 desconociendo la Constitucion, se declaro incompetente para conocer de la accion de tutela presentada por Jesus Omar Sanchez contra Computec S.A., asi como todas las actuaciones posteriores a dicho auto.
- Segundo. Ordenar que por Secretaria General, se envie el expediente al Juzgado Cuarenta Civil del Circuito de Bogota, para que, ejerciendo sus competencias constitucionales y legales, decida sobre la accion de tutela presentada.
