Se abstuvo de resolver el conflicto de competencia planteado suscitado entre dos Juzgados de Roncesvalles (Tolima) y Bogotá, respecto de la tutela incoada por el ciudadano de la referencia contra la Nación, Ministerio de Hacienda y Crédito Público, Ministerio de Educación Nacional y Departamento Administrativo de la Función Pública.
En consecuencia se remite el expediente a la Corte Suprema de Justicia, Sala de Casación Civil y Agraria, para que ella defina cuál de los dos juzgados en conflicto, es el competente para dirimir el asunto por ser el superior jerárquico común.
