Se ordenó al Juzgado Quinto Civil Municipal de Cartagena asumir el conocimiento de la tutela promovida por el ciudadano de la referencia contra el Fondo de Pensiones y Cesantías BBVA Horizonte.
Este caso se dará aplicación al principio de la perpetuatio jurisdictionis, de donde se deriva la regla, conforme a la cual, una vez radicado el conocimiento de un proceso de tutela en determinado despacho judicial, si el juez considera necesario vincular a otros sujetos para la debida protección de los derechos fundamentales, resulta inadmisible trasladarlo a otro en razón del cambio de naturaleza de las entidades demandadas.
