Se decretó la nulidad de la sentencia proferida por el Juzgado dentro de la acción de tutela de la referencia para que el juez la surta en debida forma, de manera que su decisión se adopte teniendo en cuenta el material probatorio que sirva de sustento a su criterio sobre los hechos deducidos y a la valoración que de ellos se haga.
Por lo anterior, la Corte devolvió el expediente al Juzgado respectivo para que imparta, en debida forma, el trámite judicial correspondiente a la primera instancia.
El fallo proferido y en caso de impugnación, el de segunda instancia, se enviarán a esta Corte para su eventual revisión.

- PRIMERO. DECRETAR la nulidad de la sentencia proferida por el Juzgado
- cuarto. laboral del Circuito de Barranquilla el 29 de julio de 1996,dentro de la accion de tutela de la referencia.
- SEGUNDO. ORDENAR al Juzgado
- Cuarto. laboral del Circuito de Barranquilla que imparta,en debida forma,el tramite judicial correspondiente a la primera instancia,dentro de la solicitud de tutela presentada por Jaime Enrique Cervantes Ruiz,para lo cual,por Secretaria se le devolvera el expediente.
- TERCERO. COMUNICAR la presente decision al senor Jaime Enrique Cervantes Ruiz,en la direccion que aparece en el expediente.
