Solicitud de nulidad de la sentencia T-430/16.
El apoderado del municipio de San José de Cúcuta formuló el incidente argumentando que la Sala de Revisión incurrió en un exceso de formalismo al considerar como falta de subsidiariedad la no contestación de la demanda en el proceso arbitral, desconociendo las demás actuaciones surtidas al interior de dicho proceso que resultaban fundamentales para la demostración de la medida de amparo.
Por no satisfacer el requisito formal de argumentación, la Sala Plena de la Corporación decide RECHAZAR, por improcedente, la petición de nulidad formulada.
