Conflicto de competencia suscitado entre el Juzgado Penal Municipal con Función de Control de Garantías de Sogamoso y el Juzgado Promiscuo Municipal de Nobsa.
La controversia se generó a raíz de las diferentes interpretaciones que hicieron los despachos judiciales involucrados frente al factor territorial.
Considera la Corte que el despacho judicial de Sogamoso es quien tiene competencia territorial para conocer la acción de tutela formulada, en tanto allí es donde se surten los efectos de la vulneración de los derechos fundamentales alegada.
Si dirime el asunto con la remisión del expediente al precitado juzgado para que de manera inmediata tramite y adopte la decisión de fondo a que haya lugar.
