Se abstuvo de efectuar la revisión de fondo del fallo proferido por la Sala Civil del Tribunal de la referencia por cuanto se desconoció el debido proceso y el derecho de acceso a la administración de justicia al omitir la notificación a una de las partes involucradas.
En consecuencia, exhortó a la mencionada Sala poner en conocimiento del demandado la existencia de las nulidades advertidas en la parte motiva de este proveído y dar cumplimiento a lo ordenado en esta providencia.

- PRIMERO. ABSTENERSE de efectuar la revisión de fondo del fallo proferido por la Sala Civil del Tribunal Superior del Distrito Judicial de Santafé de Bogotá, en el asunto de la referencia, por cuanto se advierten la existencia de unas causales de nulidad con respecto a lo actuado por dicha corporación.
- SEGUNDO. ORDENAR a la Sala Civil del Tribunal Superior del Distrito Judicial de Santafé de Bogotá, poner en conocimiento del demandado la existencia de las nulidades advertidas en la parte motiva de este proveído. Al citado se le hará saber que si guarda silencio las nulidades se entenderán saneadas y el proceso continuará su curso; en caso contrario, dichas nulidades serán declaradas.
- TERCERO. Por la Secretaría General, procédase a DEVOLVER el presente expediente a la Sala Civil del mencionado Tribunal para el cumplimiento de lo ordenado en el ordinal anterior.
