La declaración judicial de pertenencia de que trata esta Ley, solo recaerá sobre el inmueble o la parte de este que hayan poseído realmente el demandante por modo de los hechos positivos a que da derecho el dominio, según el Código Civil; y comprenderá ni afectara las zonas de terreno, los yacimientos de hidrocarburos demás bienes que hayan sido o sean materia de reservas de la Nación, o que haya sido declarados imprescriptibles.
