Si en los delitos indicados en el artículo anterior incurriere un colombiano no militar o un extranjero al servicio de Colombia en ramos distintos de la milicia, la pena temporal podrá rebajarse des- de una tercera parte hasta la mitad, según las circunstancias y las consecuencias que hubiere tenido el delito. Si el extranjero culpable no se hallare en ninguna forma al servicio de Colombia, y no fuere el caso de castigarle como espía, dicha pena se reducirá siempre a la mitad.
