El artículo 59 de Decreto 1651 de 1961 quedará así: Para estimar el mérito de las pruebas, éstas deben obrar en el expediente, por alguna de las siguientes circunstancias

Formar parte de la declaración.

Haberse acompañado el memorial de recurso o pedido en éste, y

Haberse practicado de oficio.
