º También podrá declararse la caducidad cuando el contratista o la persona que ejerza su representación legal incumpla el deber de denunciar hechos punibles, cuya comisión haya conocido con ocasión del contrato, que sean cometidos por integrantes de la delincuencia organizada o de grupos guerrilleros.
