Si el Superintendente o cualquiera de los funcionarios al servicio de la Superintendencia, viola la reserva comercial, o hace uso indebido de cualquier información obtenida en el desempeño de su cargo, será inmediatamente destituido, y el respectivo superior pondrá la denuncia del caso ante la autoridad competente, a fin de que se apliquen los artículos173, 279 y 306 y demás pertinentes del Código Penal.
