Consiste en expulsar del domicilio por solicitud de su morador, poseedor o tenedor, a quien reside en el mismo, en contra de su voluntad, y que haya ingresado bajo su consentimiento, haya permanecido gratuitamente y no tenga derecho legítimo de permanecer en él.
