Al celebrar los contratos de concesión la Superintendencia General de Puertos deberá contar con la seguridad que el concesionario ofrezca las condiciones suficientes para cumplir oportunamente todas las obligaciones con terceros; y en consecuencia evaluará la constitución de garantías de responsabilidad civil por el período de duración de la concesión y seis (6) meses más, las cuales deberán proteger los daños causados a operadores portuarios, titulares de mercancías y bienes y derechos de terceros.
