ARTICULO 5o . Hábeas corpus . Quien estuviere ilegalmente privado de su libertad, tiene derecho a invocar ante cualquier autoridad judicial, en todo tiempo, por sí o por interpuesta persona, el habeas corpus, el cual debe resolverse en el término de treinta y seis horas contadas desde el momento de la solicitud y sin tener en cuenta el número de retenidos.
