ARTICULO 389 . Requisitos formales . Las medidas de aseguramiento se adoptarán mediante providencia interlocutoria en que se exprese

Los hechos que se investigan, su calificación jurídica y la pena correspondiente.

Los elementos probatorios sobre la existencia del hecho y de la probable responsabilidad del sindicado, como autor o partícipe.

Las razones por las cuales no se comparten los alegatos de los sujetos procesales.
