ARTICULO 40 . OTRAS FALTAS. Además de las definidas en los artículos anteriores, constituyen falta disciplinaria la violación al régimen de inhabilidades e incompatibilidades, las prohibiciones, el abuso de los derechos o el incumplimiento de los deberes contemplados en la Constitución Política, los tratados públicos ratificados por el Gobierno Colombiano, las leyes y en los diferentes actos administrativos. La calificación de la falta será determinada por el funcionario que adelante la respectiva investigación.
