Si se suscitare colisión de competencias entre varios Jueces para conocer o no conocer de un mismo proceso penal, mientras no sea dirimida dicha colisión todos ellos estarán obligados a practicar, dentro del territorio de su respectiva jurisdicción, las primeras diligencias de investigación.

Pero al Juez o funcionario del territorio en que se encuentre o estuviere detenido el sindicado, le corresponderá resolver lo relativo a la detención o libertad.
