Art. 78. Son funcionarios de instrucción los Prefectos, Alcaldes, Corregidores é Inspectores de Policía y Tenientes políticos, cada cual en el territorio en que ejerce sus funciones, y conocerán, á prevención, en la instrucción del sumario. Como tales, tienen el deber de practicar todas las diligencias conducentes á comprobar la existencia del fraude de que tengan conocimiento, y para descubrir los delincuentes.
