En los pliegos de cargos de las licitaciones, públicas o privadas, podrá el Departamento Nacional de Provisiones exigir, según la naturaleza del negocio, fianzas y garantías1 hasta por gl 5 por 100 del valor de la. ofeáta, como respaldo de ella. Dichas fianzas y garantías se perderán a favor del Tesoro cuando el proponente, después de adjudictado algún negocio, no dé cumplimiento a sus compromisos.
