º. En la misma sentencia se dispone el avalúo de la indemnización y en el acto de la notificación o dentro de los tres días siguientes, las partes nombran cada una un perito. Si son varios los demandados y no se acordaren en la designación de un mismo perito, el Juez hace el nombramiento al día siguiente de vencerse el término señalado en el presente artículo, y de igual modo procede si uno o varios de los demandados eligieren perito y otro u otros se abstuvieren de hacerlo.
