Los restantes magistrados de la Corte, decidirán en la misma sesión si el impedimento es o no fundado. En caso afirmativo, declararán separado del conocimiento al magistrado impedido y sortearán el correspondiente conjuez. Y, en caso negativo, el magistrado continuará participando en la tramitación y decisión del asunto.
