El Ministerio de Educación Nacional organizará y reglamentará el Magisterio escolar y determinará las condiciones por las cuales un maestro puede ser cambiado, removido de su cargo, o suspendido en el ejercicio de sus funciones, teniendo en cuenta su capacidad técnica, estado de salud, conducta moral, condiciones de localidad y recompensa o ascenso por sus méritos, de acuerdo con las facultades dadas al Poder Ejecutivo por la Ley 12 de 1934 .
