Cuando la legitimación no se produce ipso jure, el instrumento público de legitimación deberá notificarse a la persona que se trate de legitimar. Y si esta vive bajo potestad marital, o es de aquellas que necesitan de tutor o curador para la administración de sus bienes, se hará la notificación a su marido o a su tutor o curador general, o en defecto de éste a un curador especial.
