La servidumbre de tránsito para transporte de aguas consiste en el de las que se necesite llevar en vasijas, de una corriente de uso público, a través de predio rural ajeno, cuando se tiene derecho a tomar las aguas según las normas legales. Todo dueño de heredad disfrutará de esta servidumbre cuando carezca de agua propia o le sea insuficiente.
