El sobreseimiento será definitivo:

Cuando aparezca que no se ha realizado el hecho que dio lugar a la investigación, o cuando ese hecho no sea constitutivo de delito;

Cuando esté claramente demostrada la inocencia del procesado, y

Cuando resulte plenamente demostrado que el hecho se realizó en alguno de los casos enumerados en los artículos 23 y 25 del Código Penal.
