Conforme al artículo 57 de la Constitución Nacional ningún nombramiento o remoción que hiciere el presidente de la república, tendrá valor ni fuerza alguna mientras no sea refrendado y comunicado por el ministro del ramo respectivo o por el jefe del departamento administrativo correspondiente, quienes, por el mismo hecho, se constituyen responsables. Se exceptúan los nombramientos de ministros del despacho y jefes de departamento administrativo.
