Art. 3.° Antes de darse el permiso de que trata el artículo anterior, el funcionario á quien corresponda darlo, hará reconocer la res, examinará su estado, tomará nota de su color, marca y demás señales particulares; hará constar el lugar de su procedencia y el modo como la hubo el individuo quo solicito la licencia. Si de tal reconocimiento resultare que la res se halla enferma ó en estado de no darse al consumo, ó que ha sido hurtada, se negará el permiso para degollarla y darla al consumo, y se procederá en el último caso á instruir la respectiva sumaria.
