El que de manera directa o por interpuesta persona obtenga para sí o para otro incremento patrimonial no justificado, y siempre que el hecho no constituya otro delito, incurrirá por ese solo hecho, en prisión de cinco (5) a diez 10 años, y en multa equivalente al valor del incremento ilícito logrado, sin perjuicio de lo previsto en el artículo 34 de la Constitución.
