Cada una de las partes nombrará un perito, si no se convinieren todas en nombrar uno solo, y el Juez otro, para el caso de discordia entre aquéllos, la cual se decidirá por la mayoría de todos los peritos; pero en el caso de que todos discordaren en cuanto a la cantidad, se adoptará el medio aritmético.

El nombramiento que haga el Juez se notificará a las partes, y el que haga cada una de éstas, a la contraria.
