Cuando los propietarios del noventa por ciento (90%) o más de los vehículos de una empresa a la que se le haya cancelado o no se le haya renovado la licencia de funcionamiento, radio de acción o modalidad, soliciten al INTRA autorización previa de constitución de una empresa de transporte, ésta se publicará y la totalidad de las rutas y horarios le serán autorizados a la nueva empresa sin necesidad de publicaciones.
